Warren Buffet on Best Real Estate Investment

Recently on CNBC, Warren Buffett stated that he would buy “millions” of single family homes if he had the means to manage them.  The more interesting comment he made during his interview was that houses will be a better investment than stocks over the long term.  A powerful comment coming from a person who built his business (and fortune) selling securities.  [Watch the video.]

It was also announced on CNBC that pending homes sales in January rose to its highest level since April 2010.  This is significant considering that back in early 2010 there was a first-time home buyer tax incentive that helped fuel the housing market.

Warren Buffet didn’t mention that banks lend money on real estate but not on stocks.

Given today’s historically low interest rates, and property values well off their 2007 peaks, there may never be a better time to invest in real estate.

Tennessee: Third Best State for Taxes

Bloomberg has published an article which concludes that Tennessee has the third lowest taxes of any state in the country. It is somewhat surprising to me that the two states that are ahead of Tennessee both have a state income tax. Mississippi has a 5% income tax, and South Carolina has a 7% income tax.

A lot of my clients feel like they are heavily taxed by Tennessee due to the Hall income tax on dividends and interest as well as gift or inheritance taxes upon transfers of wealth to younger generations. Several of our clients have moved to Florida to avoid the Hall tax, the gift tax, and the inheritance tax. It is somewhat ironic that Florida is not ranked in the best 5 states due to its heavy property taxes.

As usual, there are numerous bills before the Legislature to reduce or eliminate the Hall tax and gift and inheritiance taxes.  Lets hope that some of these bills are enacted so that we can take over the #1 ranking.

Conservator Allowed to File for Divorce on Behalf of Ward

In the attached Carnahan decision, the Tennessee Court of Appeals appointed a disabled man’s daughter as his conservator despite his objections.  The Court also allowed the daughter to file a divorce on behalf of her father.

It is somewhat unusual for a child to be appointed as a conservator ahead of a spouse who is willing and able to serve in such role. However, in this case, the ward’s wife had signed a prenuptial agreement that waived her right to seek the appointment of a conservator for him. If there had not been a prenuptial agreement, it is likely that the wife would have been appointed as the conservator due to the priorities set forth by Tennessee law.

It is also unusual for a court to give the conservator the power to file a divorce on behalf of the ward. This is generally thought to be such a personal matter that it should not be exercised by a conservator. When the daughter’s father had legal capacity, he decided to get married. By all

So while we talk a lot about different types of loans in the world of personal finance–be it car loans, mortgages or payday lenders–we often neglect to discuss one of the most common lending practices: the personal loan.

Shakespeare is quoted as saying, “Neither a borrower nor a lender be” and I’m inclined to agree with him. I’ve been on both sides of the coin and it’s not an easy situation to be in. Having borrowed $5,000 from my father to help fix up a newly purchased condo, there was always an undercurrent of judgment. Freddie Mac Needs 15 Years to Unload All REO Inventory

Sales of Freddie Mac REO homes took a dip in 3Q11 compared to the first two quarters of the year as nonperforming loans surged consistently over the previous quarter.

The number of repossessed homes plunged to 25,300, falling by 13.5% quarter-on-quarter (q-o-q) or approximately 30,000 units in 3Q11. REO sales also stumbled from 31,600 in 1Q11, the highest number recorded in the government sponsored enterprise’s (GSE) history.

In 3Q11, Freddie Mac thrust back 24,300 homes into its current inventory while disposing 25,300 REO properties at the same time. At the end of the quarter, the mortgage capital provider has already accumulated 60,000 REO properties on its books, down by 25 percent year-on-year (y-o-y) as a result of newly completed foreclosures.

If its current trend is sustained and a net 1,000 REO properties are unloaded quarterly, it would take Freddie Mac an estimated 60 quarters or 15 years to bring down its total inventory to zero in the wake of a severely constricted foreclosure pipeline attributed to loan modifications and recent regulations.
